Terms of Service

1. Introduction and definitions

These Terms of Service ("Terms") govern use of the IlMioSalone platform ("Service", "Platform") provided by IlMioSalone S.r.l. ("Provider", "we").

By accessing or using the Service, the user ("Customer", "you") fully accepts these Terms. If you do not accept the Terms, do not use the Service.

Definitions

  • Salon: The business that uses the Service
  • Staff: Users authorized by the Salon to access the Platform
  • Salon Customer: A person who books services at the Salon
  • Athena: The integrated artificial intelligence assistant

2. Service description

IlMioSalone is a SaaS platform for beauty salon management, including:

  • Calendar and appointment management
  • Customer records (CRM)
  • Staff and shift management
  • "Athena" AI assistant for conversational operations
  • Statistics dashboard and reporting
  • Payment system (where active)

3. Registration and account

  • To use the Service, you must create an account with accurate and complete information
  • The user is responsible for the security of their login credentials
  • Credentials may not be shared with unauthorized third parties
  • The Customer is responsible for all activity carried out through their account

4. Acceptable use

The user agrees to use the Service in compliance with the law and these Terms. It is expressly prohibited to:

  • Use the Service for illegal or fraudulent purposes
  • Attempt to access data from other Salons without authorization
  • Enter offensive, defamatory, or illegal content
  • Perform operations that may compromise Platform security or performance
  • Reverse engineer, decompile, or attempt to access source code
  • Use unauthorized bots or automations

5. Artificial intelligence (Athena) - Disclaimer

The Service includes an artificial intelligence assistant called "Athena". The user acknowledges and accepts that:

  • We do not guarantee accuracy: AI-generated responses may contain errors or inaccuracies. The user is responsible for verifying critical information.
  • Human supervision: Important operational decisions must be supervised by human staff.
  • No professional advice: Athena does not provide medical, legal, or financial advice.
  • Continuous improvement: AI features are constantly evolving and may change.

6. Payments and billing

Pricing plans and payment terms are specified on the Pricing page. The user accepts that:

  • Payments are processed through Stripe, a third-party PCI-DSS compliant provider
  • Subscriptions renew automatically unless canceled
  • Refunds are subject to our Refund Policy
  • Invoices are issued electronically

7. Intellectual property

  • Platform: All rights to the Platform, including software, design, and trademarks, belong to the Provider
  • Customer Data: The Customer retains ownership of the data entered into the Platform
  • License: The Customer grants the Provider a limited license to process data for Service delivery

8. Limitation of liability

To the extent permitted by applicable law:

  • The Service is provided "as is" without warranties, express or implied
  • The Provider will not be liable for indirect, incidental, special, or consequential damages
  • The Provider’s total liability is limited to the amount paid by the Customer in the 12 months before the event
  • The Provider is not responsible for interruptions caused by force majeure events

9. Account termination

  • The Customer may delete their account from Settings
  • The Provider may suspend or terminate an account in case of breach of the Terms
  • Upon termination, the Customer may request data export within 30 days
  • Data will be deleted within 90 days after termination, except where legal obligations apply

10. Privacy and data protection

Personal data processing is governed by our Privacy Policy.

11. Changes to the Terms

We reserve the right to modify these Terms. In case of substantial changes, we will notify users at least 30 days in advance. Continued use of the Service after the change constitutes acceptance of the new Terms.

12. Applicable law and competent court

These Terms are governed by Italian law. For disputes arising from these Terms, the Court of Rome has exclusive jurisdiction.
